Unfortunately, even if you haven't witnessed unsolicited groping or grinding on public transportation firsthand, you've probably heard accounts of it happening to others.

Well, there's news of this: grinding against fellow straphangers will not only be morally criminal, but actually punishable by law very soon.

This new bill will classify such behavior as a misdemeanor and carry a maximum sentence of one year in prison (or three years probation.)

Avarella Simotas, an Assemblywoman and the bill's sponsor recently stated, "I witnessed a lot of very disturbing activity that occurs on the subway. Just the other day, there was a report that somebody was masturbating in front of a female rider all the way through Astoria, my district." Ugh, gross.

She also said, “Clearly, we have to make sure that the law has adequate punishment. You confine yourself in a small space, and that’s why it’s very important that we have an enhanced penalty when somebody engages in this disturbing behavior.”

Governor Cuomo plans to sign the bill and it will be be put in effect on November 1st.

According to the bill, "forcible touching" is defined as physically contacting another individual “for the purpose of gratifying the actor’s sexual desire and with the intent to degrade or abuse.”

The new legislation specifically focuses on people who touch another person while "on a bus, train, [or] subway car operated by any transit agency or company," whether its public or private.
